Can I Do An Unconditional Withdrawal? | REALTOR.com? Blogs

Q: My house is currently on the market and I am not happy with my current agent. I signed a 1 year contract with him that expires in May 2013. I would like an unconditional withdrawal so I can either list with another agent or list as a rental property. I am a very motivated seller that would like to have something happen with my property in the next 2 months so I don?t want to be tied to this agent until May. Is there anything that I can do?

A: Call the agents broker who holds their license and explain the issues you are having and why you are unhappy. Would a different agent from the same brokerage make a difference? If you want to wash your hands completely of the brokerage, you will still need to talk with the broker who is ultimately the one who would need to sign off on a cancellation. Could you offer to reimburse the agent for the marketing dollars they are out at this point? You should give the agents broker the opportunity to make things right before you continue to push the issue. If they cannot satisfy you, then demand a cancellation or seek legal counsel.

The broker may try to move you to another agent in the office if you agree. Or they should be willing to release you from the contract.
